This contract is between Angela Smith , hereinafter referred to as Breeder and X Hereinafter referred to as BUYER(s).
Breeder agrees to sell Buyer a puppy Identified as:
AKC #__________ ASCA #________________________ Microchip ID (of pup)__________________
For the sum of $ x, of which $ x Is a non-refundable deposit.
1)* The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy parasite free and up to date with inoculations as directed by a veterinarian, proper nutrition, and fresh water available at all times. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision. {Furthermore, puppies WILL require medical attention at some point during their lifetime. Do not make this purchase if you are not prepared to pay vet expenses as all vet expenses will be buyer responsibility from this point forward. Do not make this purchase if you believe this puppy is not in good health at time of sale.} Training classes are highly recommended for a happy relationship between the dog and family.
2)* The Breeder has micro-chipped the puppy. The chip has been registered through AKC “Re-Unite” at the time of AKC registration, to the Breeder. The Breeder strongly recommends that the micro-chip be registered in the buyer’s name via AKC Re-Unite AND the chip manufacturer, in order to facilitate his/her return if lost or stolen. Breeder has provided the forms for the microchip to be registered to the Buyer.
3)* The Breeder guarantees this puppy to be of sound health at the time of this sale. A health record of all vaccinations/de-worming, and EYE exam is provided to Buyer from Breeder. The Buyer agrees to take this dog to a licensed veterinarian of their choice within 48 hours for a physical examination. Should puppy be determined to be in ill health, the cause of which the Breeder is clearly to blame, the puppy may, upon a signed written diagnosis from said licensed veterinarian, be returned for refund of the purchase price, less amount of deposit. Breeder assumes absolutely no responsibility for fees associated with caring for the puppy. No other guarantees are given. Health guarantee does not cover any parasite, internal or external, as these are common treatable conditions in puppies & dogs. Buyer has been informed that puppy has recently been de-wormed & worms may be present in the stools as de-wormer is designed to rid the intestinal tract of parasites. Buyer is aware that vaccinated puppies are still susceptible to contagious disease, and will require more than the one vaccination provided by the Breeder prior to purchase. Buyer agrees to maintain an appropriate vaccination and heartworm prevention schedule with their vet. Buyer is aware that Australian Shepherds should not be treated with non-prepared/ Off-label Ivermectin for Heartworm prevention.
4) This dog is sold with LIMITED AKC registration, and Not for Breeding ASCA registration.
4b) The Buyer agrees not to use this animal for breeding If the puppy is bred, attempted to be bred or produces a litter at any time all potential for refunds for the puppy are null and void, any potential to lift LIMITED is null and void; and the Buyer shall pay $1000 PER offense to Breeder. It is clearly understood that the puppy is not to be bred prior to lifting of LIMITED.
5)* If at any time the Buyer can no longer retain possession of this dog, the Breeder is to be notified and given first option of resuming full ownership of dog in order for the Breeder to locate this dog an appropriate home. Refunds, if any, will be at the discretion of the Breeder. The pup will be returned with all AKC and ASCA papers, signed to transfer to Breeder, and with all medical records. The Breeder reserves the right to approve/prohibit any transfer of this animal to a third party; puppy MUST be spayed or neutered prior to rehoming to a third party. Under no circumstances will this dog be sold, leased, traded or given away to any pet shop, research laboratory, or similar facility. Buyer agrees and understands that that Breeder has first right of refusal, and no refunds are promised.
6)* The Buyer agrees to contact the Breeder immediately if any questions or concerns arise about the dog, such as housing, diet, or health. The buyer agrees to keep the Breeder informed of any treatment as it occurs. Should any circumstance that affects the quality of life of the dog arise, the breeder is to be informed so that they may participate in determining the future of the dog.
7) American Kennel Club(AKC) and Australian Shepherd Club of America (ASCA) Registration papers will be provided at time of sale of the puppy. Buyer agrees to register the puppy into Buyer’s name within 60 days of purchase. It is understood at the time of sale that this is a pet quality dog and it is representative of its breed. Buyer agrees that any registry other than the AKC, ASCA or UKC, is an unacceptable registry, and agrees that this dog will not be registered with any other breed specific or all breed registry.
*Any breech of the contract by the Buyer will result in immediate return of puppy to the Breeder. Buyer and Breeder agree that Kansas State Laws apply to this contract and further agree that the place of venue if needed, shall be Riley County, Kansas.
The preceding paragraphs contain conditions established by the Breeder to ensure the well being of the puppy. The Buyer’s agreements will continue for the duration of the dog’s life and the Breeder will have the right to enforce the agreements. Any and all court costs, and attorney fees will be paid by the purchaser at the time of the court's decision.
It is understood that this agreement is to protect the integrity of the Breeder’s bloodlines. This agreement provides the Breeder with an opportunity to follow up on puppies and gives important feedback and information on the health of our dogs for future generations.
